Abstract:
The issue of public health and access to medical inventions, is one of the most important issues related to intellectual property rights. The role of patents on access to medicines and medical equipment is not absolute, Because on one hand By creating an incentive to promote innovation can provide access to new drugs that this is often true about developed countries; and on the other hand by creating an exclusive rights in medical inventions make their availability difficult, especially in low-income countries, and prevent patients to access easily. So the balance between the protection of patents and public interest including public health is very important. In recent years, some efforts have been carried out by international organizations, especially the World Trade Organization and the flexibilities are considered in international and domestic law, so that at the same time that the patent for the drugs and medical technologies be allowed also, access to essential medicines in developing and the least developed countries be provided. However, Because of the inadequacy of the flexibilities available in the TRIPS Agreement it is necessary that other strategies to be considered in other aspects of intellectual property rights to ensure public health. In this study, the flexibilities in the TRIPS agreement, including compulsory licensing, parallel imports, patent exclusions, transition periods and bolar exemptions, as well as their efficiency to create a balance between developed and developing countries goals were studied. In addition, new strategies have been proposed to complement the existing flexibilities in terms of enforcement, competition law and trademarks that can improve the public health. By preventing the innumerable spread of enforcements and border measures, to deal with anti-competitive practices and restrict the rights of trademarks owners about goods that are harmful to human health, the right to enjoyment of the highest attainable standard of physical and mental health provided better.

8 . ریشه های حمایت قانونی از حقوق مالکیت فکری در سطح ملی، به قرن 15 و 16 برمی گردد. زمانی که چندین کشور اروپایی قوانینی را برای حمایت از انواع خاصی از اموال فکری اختصاص داده بودند. در این راستا اولین قانون ثبت اختراع که به رسمیت شناخته شد، قانون 1474 ونیز بود که به اختراعات، یک دوره حمایت یک ساله اعطا می کرد؛ و اولین قانون کپی رایت، قانون انگلیسی «ان» مصوب 1709 بود. سایر کشورهای اروپایی نیز بعد از این در این زمینه اقداماتی انجام دادند و در پایان قرن 18 تعدادی از کشورها، قانون ثبت اختراع و قانون کپی رایت داشتند . ایالات متحده آمریکا نیز اولین قانون ثبت اختراع خود را در سال 1836 ارائه کرد.
